By downloading, installing, accessing, or using PICABOT AI ("the Application," "the Software," "our Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use our Application.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and PICABOT AI ("Company," "we," "us," or "our").

2.1 Application Overview

PICABOT AI is a Windows application that provides:

• AI-powered photobooth functionality
• Integration with webcams and DSLR cameras
• Access to a curated prompt gallery
• AI image generation capabilities
• Print and QR code download features
• Credit-based usage system

2.2 System Requirements

To use PICABOT AI, you must have:

• Windows 10 or later operating system
• Minimum 8GB RAM (16GB recommended)
• Compatible webcam or DSLR camera
• Active internet connection for AI processing
• Sufficient storage space for the application and generated images

3.1 Account Creation

To access certain features of PICABOT AI, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Update your information promptly when it changes
• Notify us immediately of any unauthorized use
• Accept responsibility for all activities under your account

3.2 Age Restrictions

You must be at least 13 years old to use PICABOT AI. If you are between 13 and 18 years old, you must have parental consent to use our Application.

4.1 Credit Purchase

PICABOT AI operates on a credit-based system with the following packages:

• Starter Pack: 100 credits for ₹1,000
• Professional Pack: 550 credits for ₹5,000
• Enterprise Pack: 1,100 credits for ₹10,000

4.2 Credit Usage

• Each AI image generation consumes 1 credit
• Credits are non-transferable and non-refundable except as specified in our Refund Policy
• Credits do not expire but may be subject to account inactivity policies
• We reserve the right to adjust credit pricing with 30 days' notice

4.3 Payment Terms

• All payments are processed securely through third-party payment processors
• Prices are listed in Indian Rupees (₹) and include applicable taxes
• Payment must be received before credit allocation
• We may offer promotional pricing or discounts at our discretion

5.1 Permitted Uses

You may use PICABOT AI for:

• Personal and commercial photography projects
• Event photography and entertainment
• Creative and artistic image generation
• Educational and research purposes

5.2 Prohibited Uses

You agree not to use PICABOT AI for:

• Creating, distributing, or storing illegal content
• Generating images that violate intellectual property rights
• Creating deepfakes or misleading content without proper disclosure
• Harassment, cyberbullying, or intimidation
• Spam, fraudulent, or deceptive activities
• Any purpose that violates applicable laws or regulations

6.1 Our Rights

PICABOT AI, including all software, algorithms, designs, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content Rights

• You retain ownership of images you capture using our Application
• You own the AI-generated images created through our Service
• You grant us a limited license to process your images for service provision
• You are responsible for ensuring your content doesn't infringe third-party rights

6.3 License to Use

We grant you a limited, non-exclusive, non-transferable license to use PICABOT AI in accordance with these Terms.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7.1 Data Processing

• Images are processed temporarily for AI generation
• We do not permanently store your images unless you choose to save them
• Usage data helps us improve our services
• You can request deletion of your data at any time

8.1 Service Availability

• We strive to maintain high service availability but cannot guarantee uninterrupted access
• Scheduled maintenance may temporarily affect service availability
• We will provide advance notice of planned maintenance when possible

8.2 Usage Limitations

• Fair use policies may apply to prevent abuse
• Rate limiting may be implemented for system stability
• We reserve the right to suspend accounts that violate these Terms

9.1 Service Disclaimer

PICABOT AI is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to:

• Merchantability and fitness for a particular purpose
• Accuracy or reliability of AI-generated content
• Uninterrupted or error-free operation
• Compatibility with all hardware configurations

9.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the amount paid for credits in the last 12 months
• Issues arising from third-party integrations or services

10.1 Termination by You

You may terminate your account and stop using PICABOT AI at any time by:

• Uninstalling the Application from your device
• Contacting us to close your account
• Following the account deletion process in the Application

10.2 Termination by Us

We may suspend or terminate your access immediately if:

• You violate these Terms or our policies
• Your account is involved in fraudulent or illegal activities
• We receive valid legal requests requiring termination
• We discontinue the service (with 30 days' notice)

10.3 Effect of Termination

• Your right to use PICABOT AI will cease immediately
• Unused credits may be forfeited (subject to Refund Policy)
• Your data will be deleted according to our data retention policy
• Certain provisions of these Terms will survive termination

We may update these Terms from time to time. We will:

• Notify you of material changes via email or in-app notification
• Post the updated Terms on our website
• Provide at least 30 days' notice for significant changes
• Allow you to terminate your account if you disagree with changes

Your continued use of PICABOT AI after changes take effect constitutes acceptance of the new Terms.

12.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

12.2 Dispute Resolution

Before pursuing legal action, we encourage you to:

• Contact our support team to resolve the issue amicably
• Allow us 30 days to address your concerns
• Consider mediation if direct resolution is unsuccessful

12.3 Jurisdiction

Any legal proceedings will be subject to the exclusive jurisdiction of the courts in Mumbai, India.
